Return Information
Before requesting a RMA form try some of these steps. Make the configuration as simple as possible to work first, then add other items one by one. Check manual or read me files thoroughly for jumpers settings. IRQ and I/O address to avoid conflicts. Most of times, that will work. As our statistics shows, about 80% of RMA returns can't be found any problems. Should a product fail during the warranty period you can request an RMA number. If the product have been physically damaged, burned, abused, misused, neglected, modified and it's serial number, we will no longer except the item for warranty your warranty will be void from our warranty policy. Shipping charges by all other methods and to all other destinations shall be borne by the buyer. When requesting an RMA number, customer must make sure the serial number of the product are of exact matches as the one on that we have on file. This way we can track if you are sending us the one that we shipped you. It is critical to keep the original invoice. We will not issue RMA without a copy of original invoice. The RMA number we issued will be valid for 10 days. During which, the product(s) must be shipped back to the seller for a refund or replacement. The shipping cost for any return product(s) must be freight prepaid and insured. An item you would have us requesting a RMA number to put on the package in a red maker only and a description of the problem that you are having. SPC Computers will not except any package returned to us without a RMA number on the package. NO EXCEPTIONS! We will replace or repair the item with a new or refurbished one. You will not be charged to send the item back to you.
Non-Warranty Items
Batteries of any type, fans, toner, ink cartridges, or ribbons are not warranted as they are considered consumable items.
Software incompatibility or system infected with software virus are not covered under warranty, as this is not a fault of the components/peripherals.
Physical hardware damage, rodents and all similar causes are not warranted as these are not the fault of the computer or it's components/peripherals.
RMA (Return Merchandise Authorizations Procedure)
Non-defective merchandise- Returns must include the original packaging, warranty cards, manuals, software, copy of the original invoice and all included accessories. Incomplete returns will not be accepted. Original copy of the original packaging that has been defaced, opened or written on will not be accepted! Defective merchandise, after 7-days can only be return for a replace product. If the product is found to be non-defective, a restocking fee (15%) and/ or diagnostic fee of $10.00 USD may be assessed. Customer should always provide a detail specific description of problems for defective items.
Requesting a RMA (Return Merchandise Authorizations Number)
We will e-mail you a RMA number for you to put on your package. Products shipped to SPC Computers without a RMA number will be refused! The RMA number must be clearly marked on the outside of the package with a RED MAKER. Damage or loss of goods during shipment is the sole responsibility of the customer. Insufficient packaging may result in loss of warranty. RMA number is valid for 10 days for product returns. If over the 10 days you will need to requested another RMA number. Credit is subject to a 15% restocking fee. No refund or credit will be issued after 30 days of purchase and we consider the sale to be final. SPC Computers is a distributor only. Products sold by SPC Computers are not manufactured by SPC Computers. The products may, however, be covered by each manufacturer's warranty, service, and support policy (if any). SPC Computers assigns and passes through to the Customer any warranty of the manufacturer, and Customer acknowledges that it shall have recourse only under such warranties and only as against the manufacturer of the products. SPC Computers MAKES NO REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO THE PRODUCT EXCEPT THOSE STATED IN THIS DOCUMENT. SPC Computers DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY SUCH PRODUCT, INCLUDING AND WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTIES ARISING FROM STATUTE, TRADE USAGE, COURSE OF DEALING, OR COURSE OF PERFORMANCE.
LIMITATION OF LIABILITY:
IN ALL CIRCUMSTANCES SPC
COMPUTERS MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE
PRODUCTS SOLD. SPC Computers SHALL NOT, UNDER ANY
CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT,
INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT
SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. SPC COMPUTERS SHALL NOT BE
LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR
MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS
OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT SPC COMPUTERS IS
APPRISED OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
GENERAL TERMS AND
CONDITIONS:
Payment Terms; Orders: An order is not binding upon SPC
Computers until it is accepted; SPC Computers must receive payment
before it will accept an order. Payment for product(s) ordered is due
prior to shipment. Customer can make payment by credit card, or some
other method prearranged with SPC Computers. You agree to pay the
amount(s) due as specified on the invoice or via the web site.
Shipping Charges: Your total cost for purchase of any product will
include shipping charges shown on SPC Computers invoice.
Title; Risk of Loss: SPC Computers will arrange for shipment of
ordered product(s) to the Customer, Free On Board (F.O.B.) shipping
point, meaning title to the product(s) -- excepting software-- and
risk of loss passes to the Customer upon delivery to the carrier. SPC
Computers reserves a purchase money security interest in the
product(s) until its receipt of the full amount due. Customer agrees
to allow SPC Computers to sign appropriate documents on Customer's
behalf to permit SPC Computers to protect its purchase money security
interest. Title to software will remain with the licensor(s). All
software is provided subject to the license agreement of the software
maker. Customer agrees to be bound by any software license agreement
once the seal on the package is broken. SPC Computers will advise
Customer of estimated shipping dates, but SPC Computers will, under no
circumstances, be responsible for delays in delivery, and associated
damages, due to events beyond its reasonable control, including
without limitation, acts of God or public enemy, acts of federal,
state or local government, fire, floods, civil disobedience, strikes,
lockouts, and freight embargoes.
Governing Law and Jurisdiction:
Any dispute arising out of or related to these Terms
and Conditions or the sales transaction between SPC Computers and
Customer shall be governed by the laws of the State of Michigan,
without regard to its conflicts of law rules. Specifically, the
validity, interpretation, and performance of this agreement shall not
be governed by the United Nations Convention on the International Sale
of Goods. SPC Computers and Customer consent to the exclusive
jurisdiction and the venue of the State Courts of the State of
Michigan to resolve any dispute between them related hereto, and the
parities waive all rights to contest this exclusive jurisdiction and
venue of such Courts. Finally, the Customer also agree not to bring
any legal action, based upon any legal theory including contract,
tort, equity or otherwise, against SPC Computers that is more than one
year after the date of the applicable invoice.
Severability:
If any provision contained in
this agreement is or becomes invalid, illegal, or unenforceable in
whole or in part, such invalidity, illegality, or unenforceability
shall not affect the remaining provisions and portions of this
agreement, and the invalid, illegal, or unenforceable provision shall
be deemed modified so as to have the most similar result that is valid
and enforceable under applicable Michigan law.
Waiver:
The failure of either party to
require performance by the other party of any provision of this
agreement shall not affect in any way the first party's right to
require such performance at any time thereafter. Any waiver by either
party of a breach of any provision in this agreement shall not be
taken or held by the other party to be a continuing waiver of that
provision unless such waiver is made in writing.
Entire Agreement:
These terms and conditions, together with the SPC Computers's invoice respecting the products ordered by Customer, are the complete and exclusive agreement between SPC Computers and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between SPC Computers and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
